They were supposed to call last Friday for their 81quid payment but they didnt,i did request it in writing the 12 month agreement but not a peep!
am i supposed to worry?

Hiya,

I think you'll find that they will only freeze interest once they have defaulted you and passed you onto a threatmonkey team.

At least that's how they dealt with me anyway... they reduced payments for me but still added interest for about 3 months... then they contacted me again and said we have to default you now but once we pass you on to our collection agency they will freeze interest and your balance will start to reduce... They were true to their word but after about a year when I was due for review, I discovered they'd sent me an invalid default and when they passed me to collections, they did as they usually do, and terminated the account by demanding full balance in their first letter. So, under the circumstances, it turns out I only owed them the arrears... which I've paid already..

Thank the Lord for incompetence

Spam mine case sounds like yours..let me pay for 3 mths still added intrest, they sent an invalid DN..passed me around 4 dcas asking for full balance..still not sure if me CCA is enforcable,,If it is they will only get the arrears ,,will is a lot less than they were asking..I think there is unlawful charges on the arrears also

hi again guys.
made an agreement with them over the phone to pay 81 per month and had a letter to support that.
now i have my new statement the following worries me:
1. the interest alone means that i might as well be sending an empty envelope to them every month they charge me double interest then my payment, so whats the point i will only get deeper and deeper?
2. the give the whole jargon on the statement on how i have failed to make a minimum payment although i have agreed to pay this reduced amount?
is there any point to all this, it seems you cant fight them anyway. damn i am getting depressed.
i was hoping to try and come to some arrangement which will help me save my house in the long run but this seems to be just stalling the ineviteble?

Hi Indebt1,

Looking back on my old paperwork it actually took approximately 1 year before Halifax stopped charging interest completely and defaulted me.

I feel sure that they did stop charging for the first 3-6 months of my requesting them to but I remember them starting to pile on the interest again a few months before I received the Default.

They reduced my minimum payments to approximately half of what it should have been but constantly reminded me I was in arrears and this is what they used to default me and pass on to their collection agency.

Once the debt was passed on to Blair Oliver and Scott the agreement was terminated and the interest was too.

All in all I believe my account was pretty much at a standstill for that year. I paid what I could afford... they froze interest...debt started to go down... I carried on paying what I could afford... they started charging interest again... I was back to square 1.

All I can advise at the moment, If you are happy to keep in contact with them is to keep badgering them about freezing the interest.

They do eventually come around.

Sorry to hop in without ringing...
I had the same thing (an agreement somehow which I have signed) but Halifax did not charge anymore interets for 1 year, then I have reclaimed my charges, then CCA them (ongoing) and only now, after 1and 1/2 year they seem to add interest. Thay only settled my charges now after 6 months as I went through FOS, but I will dispute the interets applied this month and I want the compensation... But as far as i know once they do not have any executed CCA then how did the 1 year agreement can be in place???? I am sure you can not have an agreement over a non original existance..???

i know have a local charity looking at my overall finances, based on the CCA provided with their dodgy terms on the back, for example the front vertical reference relates to 08/00 and the back 12/00 there is another member who has posted up the same ref num on the front in the same year but a different one for the back.
sorry if its confusing but it reall seems a copy and paste,also "i have recieved a copy and agreed to be bound by the conditions of use" shurley it should read "i have read the conditions overleaf".
what i am trying to ask if its any point for the charity trying to help me to approach Halifax and negotiate a low settlement or just wait for DCA?
any help is most appriciated.

i appointed a lawyer and they deemmy agreement to be unenforecable
if you are not worried about your credit rating short term let the DCA come ...if your agreement has the copy t & cs on the back i doubt they will take you to court with an unenforceable agreement...

that said there are a number of test cases going on currently that should give us and the lenders a clearer path going forward

sent a letter through offering settlement, (was rejected suprise suprise !)
Now recived a a DN dated 22nd Dec giving me till the 12th Jan to respond or they terminate, then a letter dated the 4th Jan terminating the agreement? can they do this? does this affect the legal status of the DN?
What to do now? send a bemused letter stating that i do not accept the agreement to be a true copy?

cant help you on the DN side etc , I am in the hands of a london lawyer who is engaging with halifax on my behalf and i'll update my thread as things develop, you have the same agreemnent with the dodgy t & cs on the back so i'llkeep you updated
